1 All Ring-Tone purchases, and Ring-Tone downloads from this site or any associated server, are subject to the following terms and conditions, which you have to accept prior to placing an order, or downloading a free test tone.
2 You are purchasing a license to download a Ring-Tone once, to a single mobile phone and to use that ringtone on that phone for as long as you wish. Should you loose the downloaded Ring-Tone from your phone for any reason, you will have to purchase another license. All other rights in the Ringtone are reserved and shall remain vested at all times in Beinn Ghuilean Ltd.
3 Where information is provided about the tune on which a ring-tone is based, this is provided in good faith. Beinn Ghuilean Limited does not however guarantee the accuracy of such information, and you should not rely on this information when choosing a ring-tone.
4 It is your responsibility to ensure that your mobile phone is set up correctly to download and store the Ring-Tone. Free of charge test Ring-Tones are available from this site to enable you to test your phone's ability both to receive and play a tone of the type selected.
5 It is your responsibilty to correctly select the Ring-Tone you desire. In order to make a ring-tone we have to extract the "essence of the tune" on which the tone is based. The tone is named after the tune, and a sample is made available for you to hear the Ring-Tone in full on your PC. None of our Ring-Tones are the whole of the tune after which the tone is named, as the resulting file size would be unlikely to fit inside many mobile phones.
6 It is your responsibility to ensure that you are satisfied with sound quality of our Ring-Tones on your mobile phone prior to purchase. Free of charge test Ring-Tones are available from this site for this purpose.
7 It is your responsibility to provide us with the correct mobile number and country code, as part of the ordering process, so that we can send the download location to that mobile phone. If you enter the incorrect mobile number and that mobile then downloads the tone, then you will be deemed to have gifted the use of that tone to that mobile phones owner, and have to purchase another download for yourself.
8 If we are satisfied that you have discharged your responsibilities under sections 4 through 7, but you have not received the Ring-Tone you have ordered, we may at our sole discretion set-up a free of charge download for you, subject to you providing us with a valid PayPal Transaction ID Number. (You can find this either on your PayPal receipt email, or by logging onto your paypal account.) This should not be relied upon as an alternative to discharging your responsibility under section 4 above, as we will only do this once per "paid for order".
9 Because of the nature of the transaction, and the safeguards we have put in place to allow you to test both the suitablity of the Ring-Tone for your phone, and to test your ability to download it, you agree that you will not be entitled to any refund, should you not be able to download or play any Ring-Tone as ordered.
10 You agree that we are not responsible for any loss of content, or functionality from your phone, which may have resulted from your downloading a Ring-Tone from this site.
11 The maximum amount of any damages the we will be liable in any event is limited to the value of the transaction.
12 Beinn Ghuilean Ltd is registered to store data (information) about customers, lawfully and in accordance with the Data Protection Act 1998 of the United Kingdom. Information on customers is collected through the ordering process, and customers can opt out separately from receiving futher communications from Beinn Ghuilean Ltd or from selected third parties. Any item of data given at the time of ordering or registration is collected and stored by Beinn Ghuilean Ltd. Customers may opt out by contacting us directly.
Excepting your mobile phone number, the information which you provide and permit use of may be used by Beinn Ghuilean Ltd who may contact you regarding other goods and services related to Scottish Ringtones, or associated brands, and where this information is agreed to be passed to third parties, may also be passed to other companies who may contact you about other goods and services in which you may be interested. Furthermore, aggregated data may be used to analyse sales and customer trends.
Your mobile phone number will only be used to send you the download text message, and in the event of a problem where attemps to communicate with you by email has failed, to send text messages pusuant to resolving issues with respect to your order.

13 In respect of countries, such as the USA, which have "double opt in" regulations with respect to business communications, you hereby agree to our communicating with you via your mobile phone or email in order to resolve any problems that may arise with your order.
14 Beinn Ghuilean Ltd does not store credit any card details on any of it's servers, as the payment process is subcontracted to PayPal, an eBay company. For details of their Terms & Conditions visit www.PayPal.co.uk.
